The threat of government overreach is a very real problem with the Biden administration in the White House. Already, Biden has pushed for sweeping gun control measures, something that Republican governors are working to push back against. This comes on top of H.R. 1, a bill Democrats are pushing to strip states of the power to manage their own elections.
This month, the Biden administration chose to cancel South Dakota’s Mount Rushmore fireworks celebration slated for July 4. Kristi Noem, the Republican governor of South Dakota, is not happy about this and made clear this morning that she won’t stand for it.
Today, Governor Noem officially field a lawsuit against the Biden administration, as Fox News confirms.
A Closer Look at South Dakota’s Lawsuit Against the Biden Administration
The lawsuit against the Biden White House was filed by Noem in the U.S. District Court for the District of South Dakota Central Division.
In the suit, the South Dakota governor explains that the Biden administration promised to get back to the state regarding the memorandum agreement, yet never followed through. By canceling the Mount Rushmore fireworks celebration, the current administration is in breach of the aforementioned agreement; this is a problem that Noem seeks to fix.

The ultimate goal of the South Dakota governor’s lawsuit is to regain the fireworks permit to allow the Mount Rushmore Independence Day celebration. As a result of COVID-19, the National Parks Service has worked to distance itself from South Dakota’s annual fireworks event.
Keeping the Federal Government Out of State Affairs
The Biden administration is on a trail to blur the lines between the affairs of the federal government and of states. H.R. 1, sweeping gun control restrictions, and now the cancellation of July 4’s Mouth Rushmore event are just the latest examples.
When Biden delivered his congressional address earlier this week, the themes of his message were higher taxes, more government control, and excessively wasteful spending. Republicans condemned this rhetoric; however, it remains very much on brand for the manner of leadership adopted by President Biden.
