Over the course of this past week, Epic Games, the developer of the immensely well-known video game Fortnite, was slammed with the largest judgment ever. This was imposed by the Federal Trade Commission for a policy violation.
Fortnite Forced to Refund Customers
The game developer is being forced to pay $520 million for breaking the Children’s Online Privacy Protection Act and for employing “dark themes” to induce millions of users to make accidental in-game transactions.
Fortnite is a free-to-play game that generates billions of dollars through in-game expenditures, such as digitized skins for player characters and season “Battle Passes.” These reward players with valuable stuff as a user spends an excessive quantity of time gaming.
In a news release detailing Epic’s infractions, the FTC stated the game’s perplexing, irregular, and unclear button arrangement led to gamers incurring unauthorized charges based on the push of a button, including when users believed the program was in sleep mode or still loading.

The FTC stated that these practices led to hundreds of millions of dollars in unlawful customer payments.
Fortnite permitted youngsters to acquire in-game cash without demanding any action or authorization from guardians or cardholders.
Parents claimed their children managed to rack up hundreds of dollars in expenses before they discovered that Epic had billed their credit cards without their permission or knowledge.
Epic stated in reaction to the fine that the rules have not been altered, but their implementation has altered and longstanding sales tactics are no longer sufficient.
He went on to say they have agreed to this arrangement, due to their desire for Epic to be on the frontline of consumer safety and offer their gamers the greatest possible experience with their products.

$245 million of the $520 million fine will be cast aside for refunds to customers.
How do you know if you are entitled to a Fortnite reimbursement?
Three categories can anticipate receiving refunds:
- Households whose children made illicit purchases between January 2017 and November 2018 from the Epic Games Store
- Gamers who were billed Fortnite’s in-game currency for products they did not intend to purchase between January 2017 and September 2022
- Individuals who had accounts locked as a result of disputing unauthorized activity with their credit card issuers
