Senator Elissa Slotkin publicly refused to cooperate with a Department of Justice investigation into a video she and five other Democratic lawmakers released urging military personnel to disobey unlawful orders, branding the probe as political intimidation while her family endures credible threats and harassment.
Democrats Advise Troops on Constitutional Duty
Six Democratic lawmakers released a 90-second video in November 2025 urging U.S. military and intelligence personnel to refuse orders violating the Constitution or law. Senators Elissa Slotkin and Mark Kelly, along with Representatives Jason Crow, Chris Deluzio, Chrissy Houlahan, and Maggie Goodlander, all share military or intelligence backgrounds. Their message coincided with controversies surrounding Trump administration military actions in the Caribbean and Pacific, providing preemptive guidance rooted in the Uniform Code of Military Justice Article 92, which mandates disobedience of unlawful orders.
Trump Labels Lawmakers Seditious
President Trump responded by posting on social media that the lawmakers engaged in “seditious behavior, punishable by DEATH!” He branded them the “Seditious Six,” triggering FBI and DOJ investigations led by U.S. Attorney Jeanine Pirro in Washington, D.C. Secretary of Defense Pete Hegseth called the video “reckless and seditious,” claiming it undermines military discipline. The Pentagon initiated proceedings against Kelly to downgrade his Navy retirement rank and pension. This aggressive response raises serious concerns about constitutional protections for free speech and congressional oversight, particularly when sitting lawmakers face retaliation for advising servicemembers on their legal obligations.
Slotkin Refuses Cooperation Amid Threats
On January 14, 2026, Slotkin confirmed the DOJ investigation publicly and released a defiant video response refusing to participate in interviews. She accused the administration of weaponizing federal agencies to silence critics. Slotkin reported receiving over 1,000 threats since the video’s release, with more than 100 deemed credible, including a bomb threat and swatting of her family home. She now receives 24/7 Capitol Police protection. Her refusal to comply with what she characterizes as political harassment demonstrates backbone, though it escalates tensions between Congress and executive agencies under partisan control.
Legal Experts Reject Sedition Claims
Constitutional scholars and military law experts unanimously dismiss the sedition allegations as baseless. Legal analysts confirmed to TIME that the video constitutes a “correct statement of law,” as refusing unlawful orders is doctrinally sound under military justice principles established after Nuremberg. The Constitution Center noted that sedition requires conspiring to overthrow government, while Article III treason demands overt acts and two witnesses. The video contains neither element, merely advising compliance with existing military law. This legal clarity exposes the investigations as politically motivated intimidation rather than legitimate law enforcement, undermining the rule of law conservatives claim to defend.

Kelly filed a lawsuit against Hegseth and the Pentagon challenging the demotion proceedings. Representatives Deluzio, Houlahan, and Goodlander confirmed receiving similar DOJ inquiries by January 15, 2026. All lawmakers characterized the investigations as harassment campaigns designed to punish constitutionally protected speech. The coordinated federal response against military veterans who served their country reveals an alarming willingness to abuse investigative powers against political opponents, setting a dangerous precedent for executive overreach.
Constitutional Crisis Looms
This confrontation tests fundamental constitutional boundaries between executive authority and congressional independence. The investigations chill legitimate dissent within the military community and create conflicting signals about servicemembers’ obligations to refuse illegal orders. Short-term impacts include heightened security requirements for targeted lawmakers and their families, while long-term consequences may establish precedents allowing executive branches to probe sitting legislators for policy disagreements. The affected communities span military and intelligence personnel navigating unclear command authority, along with voters in Michigan, Arizona, Pennsylvania, Colorado, and New Hampshire whose elected representatives face federal retaliation.

I hope they bust Kelly down to a deck hand on a garbage scow for his treasonous outbursts! Only a democrat would do such a thing while still holding rank in the US navy!!!
To whom it may concern. This is an unprecedented act by these six Senators. Orders come from the Commander and Chief and Military Authorities, of which these six are not in any authority to do otherwise. To tell our military members to defy any orders is wrong and confusing to them. Senators are Senators and to take care of their constituents and to uphold the Constitution. Nowhere in the Constitution does it say or give any authority to Senators or Congressional Representatives to have or give any authority to over the Military to tell the troops what they should or should not do. Are they a part of Military Leadership to give orders? Absolutely not, they are not a part of the Military Chain of Command to give orders to our Men and Women in uniform. If you take a look of the Military Chain of Command, absolutely nowhere is it listed that Senator and Congressional representatives are part of The Chain of Command. I am Retired Military Veteran and I always and will always follow the correct Military Chain of Command. No other commands otherwise from anyone else, Senate and Congressional Representatives need to stop inserting themselves into something that they have no Authority to do otherwise, regardless if they are retired military or not !!!
